1. Acceptance of Terms

By accessing and using Healthy Beetle ("the Service"), you accept and agree to be bound by these Terms of Service. This includes understanding that we are not HIPAA-compliant and that you share any health information at your own risk. If you do not agree to these Terms, you must not use the Service.

2. Description of Service

Healthy Beetle provides nutrition tracking, meal planning, exercise logging, and related wellness tools. The Service is NOT a medical platform, NOT HIPAA-certified, and should NOT be used for storing sensitive medical information. The Service includes web applications, mobile applications, and related features.

3. User Accounts & Responsibility

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the security of your account and password
• You are responsible for all activities that occur under your account
• You must be at least 13 years old to use the Service
• You must notify us immediately of any unauthorized use of your account
• You acknowledge that any health data stored in your account is not HIPAA-protected
• You assume full responsibility for the types of information you choose to store

4. Health Information Risks & Your Acknowledgment

BY USING THIS SERVICE, YOU EXPLICITLY ACKNOWLEDGE AND AGREE THAT:

• Healthy Beetle is NOT a HIPAA-covered entity
• We do NOT provide HIPAA-compliant data storage or transmission
• Any health, medical, or fitness information you provide is shared AT YOUR OWN RISK
• We are NOT responsible for any consequences arising from storing or sharing your health information
• You waive any claims related to HIPAA compliance or medical data protection standards
• You will not hold us liable for any disclosure, breach, or misuse of your health information
• If you require HIPAA-compliant services, you should NOT use Healthy Beetle

5. User Content & Data

You retain ownership of content you submit. By submitting content, you grant Healthy Beetle a worldwide, non-exclusive, royalty-free license to use, store, and display your content for providing the Service. You acknowledge this content may include health information that is not HIPAA-protected.

6. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose
• Upload viruses or malicious code
• Attempt unauthorized access to the Service
• Harass, abuse, or harm other users
• Impersonate any person or entity
• Share your account with others
• Use the Service to spam
• Store highly sensitive medical information that requires HIPAA protection
• Rely on the Service for medical record keeping

7. Health and Medical Disclaimer

CRITICAL DISCLAIMER:

• Healthy Beetle is NOT a medical service or healthcare provider
• We are NOT HIPAA-certified or compliant
• The Service is NOT a substitute for professional medical advice, diagnosis, or treatment
• Always consult qualified healthcare providers for medical advice
• Never disregard professional medical advice because of something on Healthy Beetle
• If you have a medical emergency, call emergency services immediately
• We do not provide medical advice, diagnosis, or treatment recommendations
• Nutrition and exercise suggestions are general and may not be suitable for everyone
• Any health information you store is at your own risk

8. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

HEALTHY BEETLE SHALL NOT BE LIABLE FOR:

• Any damages arising from your decision to store health information on a non-HIPAA-compliant platform
• Unauthorized access to or disclosure of your health information
• Loss, corruption, or breach of your personal or medical data
• Any consequences from third-party access to your information
• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, goodwill, or other intangible losses
• Any claims related to HIPAA non-compliance

YOU USE THIS SERVICE ENTIRELY AT YOUR OWN RISK.

9. Indemnification

You agree to indemnify, defend, and hold harmless Healthy Beetle, its officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another
• Any claims related to your decision to store health information on our non-HIPAA-compliant platform
• Any consequences arising from the disclosure of your health information

10. AI Features and Third-Party Integrations

• AI features provide estimates that may not be 100% accurate
• Always verify AI-generated nutrition information
• Third-party integrations are subject to their own terms and privacy policies
• Neither our AI features nor third-party integrations are HIPAA-compliant
• We are not responsible for third-party services or their data practices

11. Privacy

Your use is governed by our Privacy Policy, which clearly states we are not HIPAA-compliant. By using the Service, you acknowledge you have read and understood our privacy practices and limitations.

12. Security Measures & Limitations

While we implement industry-standard security measures:

• We do NOT guarantee HIPAA-level security
• No internet service can guarantee 100% security
• You acknowledge the inherent risks of storing health data online
• We are not liable for any security breaches or data loss

13. Termination

• We may terminate or suspend your account at any time for Terms violations
• You may delete your account through profile settings
• Upon termination, your right to use the Service ceases immediately
• We are not obligated to maintain or return your data after termination

14. Warranty Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE SPECIFICALLY DISCLAIM ANY WARRANTIES REGARDING HIPAA COMPLIANCE, DATA SECURITY, OR FITNESS FOR STORING MEDICAL INFORMATION.

15. Changes to Terms of Service

We reserve the right to modify these Terms at any time. Material changes will be notified with at least 30 days notice. Continued use after changes constitutes acceptance.

16. Governing Law

These Terms are governed by United States law, without regard to conflict of law provisions. Any disputes shall be resolved in the appropriate courts of the United States.

17. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.
